ALSO BECAUSE I AM ON DISABILITY GETTING A FEE WAIVER FOR COURT COSTS IS AS EASY AS TICKING ONE BOX ON THE FEE WAIVER FORM!

ALL I NEED TO DO TO HAVE COURT COSTS WAIVED IS PUT A CHECKMARK IN THE LITTLE BOX BESIDE THE WORDS "SOCIAL ASSISTANCE"!

I DO NOT HAVE TO FILL OUT ANY OF THE FINANCIAL FORMS TO GET A FEE WAIVER BECAUSE I'M ON DISABILITY! I JUST HAVE TO PUT A CHECKMARK IN THE LITTLE BOX BESIDE THE WORDS "SOCIAL ASSISTANCE" AND THEN SKIP OVER ALL OF THE CRAP THAT I DON'T HAVE TO FILL OUT BECAUSE IT SAYS SKIP TO THE SIGNATURE SECTION IF YOU PUT A CHECKMARK IN THE LITTLE BOX!

TO GET THE FEE WAIVER I JUST HAVE TO FILL IN THE PERSONAL INFORMATION. e.g. name, etc. Then I just have to tick the little box specifying what court the fee waiver is for. Then I just have to tick the little box that says I'm on social assistance. Then I just have to read the little blurb that says to skip over everything else and go to the section where I have to sign my name and date the form.

Then I just have to take the completed fee waiver form along with my statement of claim (in triplicate) to the courthouse to file. The fee waiver is rubber stamped because I am on social assistance. People not on social assistance have to provide a full accounting of their income, assets, and expenses. People on social assistance do not! People on social assistance get their fee waivers rubber stamped "APPROVED"!

Then once the claim is filed and the clerk puts the court seal on the three copies, the clerk keeps the original copy and gives me back the other two copies. One of those two copies is for me to keep and the other is for me to have served on the person I am suing. I can either personally serve the statement of claim or I can have a friend, relative or acquaintance serve the statement of claim on the defendant. I can also avail myself of the services of a process server.

My intent is to avail myself of the services of a process server. The process server for a reasonable fee will serve the documents on the defendant and swear or affirm that the claim has been served on the defendant in an affidavit of service at the court.

And that sets the ball in motion.

The defendant gets a relatively short period of time to file their defence with the court or run the risk of a default judgement. Because that's what happens when you don't file a defence; you lose by default.

And the best part is that you cannot refuse to accept service. The process server knows that if you refuse to receive service of the documents he/she only has to drop the documents at your feet. And dropping the documents at your feet constitutes service of the documents and the process server can then swear or affirm an affidavit that the documents have been served.
