Brother is going to prison

So to be clear, my brother is special needs. He’s 25 and has severe autism, PTSD from prolonged child abuse and the mental capacity of a 13 year old and he has been an alcoholic since he was 14.

He was charged with 27 felonies against a minor. The victim was 12.

They dropped 26 of the 27 charges because it turned out that the victim lied about her age. She said she was 23. She also sent him photos of an adult woman and claimed it was her. She also lied about having sexual contact with my brother.

However, even though the victim lied about her age the law protects her. My brother sent an explicit video he found online to her and a nude photo (which she asked for).

So my brother will be going to prison for 3 years due to a little lying brat. He will be a sex offender for 20 years. He’s feeling suicidal. I feel so bad because he was excited to have his first girlfriend, he was looking forward to life. Even the prosecutor of the case said he wished he could give my brother zero years but that the victim’s family was pushing for the maximum 8 years. They had to come to a resolution so they settled on 3.

I tried so hard to protect my brother. I feel so terrible. We had no parents. I wish I did better.
